GRANGEVILLE — The survivor in a 2013 fatality crash is claiming negligence in a civil suit filed in District Court.
Date for a jury trial is pending for Nathan J. Manfull, who is seeking damages in amounts yet to be determined for injuries and disability, as well as pain and suffering and loss of income. The suit alleges negligence on the part of the driver, Megan M. Lyle of Prineville, Ore., who died in the July 14, 2013, accident.
The incident was reported on Forest Road 234 south of Elk City, according to Free Press news coverage, when Lyle lost control of her southbound 1987 Toyota 4-Runner on a curve and the vehicle overturned.
Manfull remained in the vehicle while Lyle was ejected and, according to the suit, subsequently pinned under the rear axle when the vehicle rolled.
Manfull’s suit against Lyle’s estate claims driver negligence contributed to the accident, including a failure to maintain control of the vehicle and to avoid the collision, and inattentive driving.
