No charges planned following fatal crash

— No charges will be filed following Sunday’s fatal vehicle vs. pedestrian accident at Winchester that resulted in the death of a Lewis County man.

According to the Idaho State Police (ISP), after investigating the scene and interviewing all involved, no charges will be filed as the involved driver — Jimmie R. Eckwortzel, 70, of Lucile — was not able to avoid the collision with the victim. Based on witness statements, the victim was stationary on the side of the road and then made an intentional move into the lane of travel. The vehicle involved did not have time to avoid the collision.

The incident was reported May 20 at approximately 12:35 p.m. near milepost 280 on U.S. Highway 95 north of Winchester. According to ISP, Cody was walking on the northbound shoulder, entered the roadway and was struck by Eckwortzel’s 2003 Toyota Tundra.

Prior to this time, the Lewis County Sheriff’s Office was informed Cody did not return to his residence at 11:45 a.m. A search was mobilizing and additional information was being sought when the crash was reported. At that time, it was turned over to ISP for investigation.
